Terms of Use for Fieldguard

These Terms of Use (the "Terms") govern your access to and use of the "Fieldguard" mobile application and website (the "Service"), owned and operated by Dmytro Uhryn ("we," "us," or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, please discontinue using the Service.
1. Service Description
Fieldguard provides air threat alerts as well as tools for organizational employee safety checks ("Safety Check") and emergency SOS signals. Features include receiving push notifications, sending custom notifications to selected recipients or groups via the admin dashboard, viewing alert and notification history, managing alert settings, and activating SOS signals with location transmission for emergency assistance.
2. Important Disclaimer about Data Sources
Information about air raid alerts in the Service is aggregated from open sources and third-party public channels. We do not guarantee the completeness, timeliness, or accuracy of this information and we are not liable for any consequences arising from its use. We strongly recommend that you always follow official warnings and instructions from local and national authorities, public warning systems (sirens), and official apps and resources. Safety decisions should be made with reference to official sources.
3. Account and Security
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- You agree to notify us immediately of any unauthorized use of your account.
4. Payments, Subscription, and Trial
- Certain features may require an active subscription or a license key.
- Payments, where applicable, are governed by the terms of the respective payment provider.
- We may change prices and subscription terms with prior notice, as permitted by applicable law.
5. Acceptable Use
- You must not use the Service for illegal activities or to cause harm to others.
- Reverse engineering, unauthorized access, circumvention of technical limitations, or mass automated interactions with the Service are prohibited.
6. Intellectual Property
All intellectual property rights in the Service materials (logos, text, images, software code) are owned by us or used under license. Reproduction, distribution, or creation of derivative works is prohibited without our prior written consent, unless expressly permitted by these Terms or by law.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available." We make no warranties regarding uninterrupted operation, error-free performance, compatibility, or fitness for a particular purpose. We do not warrant the accuracy of any notifications or data in the Service, including air threat information. The SOS function does not guarantee the provision of emergency assistance or rapid response to your signal.
8. Limitation of Liability
To the extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including loss of data, profits, goodwill, or business interruption, arising out of or in connection with your use of or inability to use the Service.
9. Termination
We may suspend or terminate your access to the Service if you violate these Terms or for other reasons permitted by law, with or without notice, where legally permissible.
10. Changes to the Terms
We may update these Terms from time to time. We will notify you of material changes through the Service or by other available means. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
